"In 2009 my house was raided in June and august .In June I was arrested and interviewed and as annoyed as I was at the time I had to wait at the police station for several hours before being interviewed as the police informed me I could not be interviewed without an appropriate adult to comply with PACE regulations as I have bipolar disorder, post-traumatic stress disorder and general anxiety disorder. When the appropriate adult arrived a solicitor was arranged also .At this time I was released without charge .In August 2009 I was arrested by another police force , at this time I had recently been prescribed additional medication due to being manic .I was interviewed without an appropriate adult or a solicitor and not being aware of the seriousness of the matter and its implications I waffled on and said things out of context though the police said to me they considered I hadn’t done anything too serious and that if I made a statement against a certain individual I would not be charged with any offense .Not having been in trouble with the police in my life and being manic I said I would think about it , something that with hind sight was a terrible decision and was about to set off a chain of events I could never imagined happening. After being released on bail I asked someone I thought was a friend for their advice and they referred me to a solicitor, little did I know this solicitor was not a real solicitor but did work for a firm of solicitors. Meeting with the solicitor I was advised not to make a statement and that I was not guilty of any offense .I reported for bail at the police station a week or so later with an employee of the form of solicitors .The police told the solicitor that I would not be charged if I made a statement but as the previous “solicitor” from the firm told me not to make a statement I declined and was charged with conspiracy to defraud, something at the time I was not aware of the seriousness of that charge .I am skipping ahead here .I attended crown court for something called a plea and directions hearing .I had not had a meeting with a barrister or been explained to and reviewed any evidence against me
Again I had never been in trouble with the police so I had no idea of criminal proceedings and what should and should not happen. Arriving at crown court there was not solicitor and I was approached by a barrister I had never met and told he would be representing me .He informed me that he had spoken with the prosecution and said that if I pleaded guilty and made the statement previously requested I would receive a suspended sentence .There were 5 other defendants involved in the case all were present .I was dealt with separately and taken into the court and pleaded guilty to the offense of conspiracy to defraud and then was taken to a police station where I made a statement against one of the other defendants, accompanied by a solicitor from the firm who had arrived and also I had not previously seen .apparently the fake solicitor was otherwise engaged on this day .
After making the statement called the fake solicitor and told him of the events of that day .He seemed to be angry and repeated that I should not have pleaded guilty it was at this point I began to realise something was not right so I spoke to a friend and explained what had happened so far . They were shocked and informed me that it seemed I had been manipulated. The friend arranged a call with a solicitor and after speaking with that solicitor and going through the events to that point I then realised the serious situation I was now in .I made several attempts to change my solicitors unaware that the fake solicitor and the firm he worked for were blocking my attempts to change solicitors and my legal aid .The next step I took set off what I can only describe as a holocaust of events. I made a complaint to the legal ombudsman which on advice I sent directly to the ombudsman and not to the solicitors. The ombudsman contacted me and said they had sent the complaint to the solicitor firm as this was the correct procedure. The day after the solicitors had received a copy of the complaint I received a phone call threatening my life and that of my dogs if I did not drop the complaint against the firm of solicitors .I called the police directly after receiving this call from a withheld number and informed them as to what at happened .The next day the police visited my home and it seemed they knew this firm of solicitors as the head of the firm was previously a policeman for 30 years and had become a solicitor. I was also visited by a well-known criminal several times trying to get me to withdraw the complaint being threatened with a real gun on one of the occasions.
I was offered to be moved to a safe house but my dogs , a very important and essential part of my life, were not be able to come with me.I was in a state extreme fear and a level of anxiety I had not experienced before. However I declined to be moved as being without my pack of 4 large dogs (mastiffs, mum dad their daughter and son my family) was not something I could have coped with. I had an empty police car parked outside my house I had a panic button installed a flag put on my phone (priority calls to the police) I had twice daily visits from the police
A few days after this, again skipping through events, I was escorted by witness protection to crown court and went before a judge who agreed my solicitors should be changed .This was just before Christmas 2009 and it wasn’t until early January 2010 that I had meetings with my new solicitors and new barrister .I was informed that I had only 3 days to decide what to do , to plead not guilty or to plead guilty on a particular basis a much lesser charge .This is where many will not understand the next decision I made .During the period between having my solicitors changed and the time I actually met with the barrister I had turned to the internet , now armed with a clearer understanding and knowledge of proceedings , I researched case law and came across several cases where a defendant had successfully appealed against their charge due to being interviewed without an appropriate adult and solicitor and being in a state of mania or hyper mania (states of bipolar instability, high mood ).Even being aware of this I decided to plead guilty on a basis .By this time I had endured so much and was in severe mental distress and the thought of going to trial as opposed to simply pleading guilty on a basis with an almost certain outcome of a suspended sentence I took what at the time I thought was the most simple route and pleaded guilty I thought I would simply appeal against the decision within the 12 month allowed period
I was informed that the police had traced the threatening call made to me at 7.30 pm was made by the firm of solicitors in particular the solicitor that had previously been a policeman for 30 years. He was arrested in crown court and taken into police custody.
During this time I was under witness protection at my own home having refused to be relocated as my dogs would not be able to come with me.I had a panic button, cameras, a “flag” on my phones (priority calls to police) and was visited twice daily by police who had to have a password should be unsure as to who they were and could ask for it and had secret surveillance cameras installed and had an empty police car parked outside my house.
This was a time of unbelievable stress knowing that organised crime individuals and associates of the crooked solicitors who wanted to kill me as it had been arranged for me to take the burden of blame for one of the main defendants and I was expected to accept being manipulated and not fight against the situation and potentially receive a 6year prison sentence which is what the main defendant received .during this period for which I was extremely mentally unstable I rarely ventured out my house, even to walk the dogs.
At my sentencing hearing an unusual event occurred One of the strangest things that happened that day was regarding the reference the police said they would be doing to give to the judge who would be sentencing me my barrister asked my permission to have sight of or confirm it was with the judge the prosecution was clueless about the existence of the reference and was most keen to see what it contained .Well 2 plain clothed police arrived and went to the judge’s chambers where my barrister and the prosecution barrister were also present the reference was handed to the judge who then after having read it was told he had to return it back to the 2 plain clothed police officers not being allowed to even keep a copy and the prosecution barrister and my defence barrister were refused sight of the reference my barrister said it was something he hadn’t experienced in all his thirty years and the prosecution barrister seemed put out he wasn't able to see the contents only the judge .
After all these event I was emotionally and physically drained due to sleep deprivation and was in a zombie like state for some time after. Before the 12 month period had elapsed where I could appeal against my sentence I was then raided by HMRC on a matter relating to one of my clients (I was a part time self-employed accountant working from home) Again I was interviewed without an appropriate adult, even though I had asked for one and also without a solicitor as there the one I was offered members of their staff were in crown court that same day being charged criminally with offenses which I had helped police with. Fortunately I asked for a copy of the interview tapes .After this I engaged the services of a large and competent firm of solicitors .HMRC had taken my computer on which there were highly sensitive and secret legal documents relating to the previous case including covert voice recordings I had made at great risk to myself also documents relating to specific police corruption, I will say no more about that here.Several months after the interview with HMRC where I had no appropriate or solicitor , I received a phone call from the officer leading the investigation saying “ based on documents on your computer , I note that you should have had an appropriate adult and a solicitor” , and I would have to be re interviewed as the first interview would be in admissible .When I informed the officer that I had the tapes from the first interview he seemed upset at this .Having now gained substantial legal knowledge , I knew this was because he could not legally ask the same questions as he had in the first interview.
Before I was re interviewed my partner who I had been with for 28 years died suddenly and expectedly and I had taken an overdose and was under the care of the mental health crisis team. Arriving at the police station with my appropriate adult and solicitor I was advised to do a no comment interview which the HMRC was informed I would be doing so before the interview started. I was visibly distressed but was still interviewed for several hours and made no comments in response to the questions I was asked.
Skipping ahead , the prosecution evidence was made available to my solicitors and I was informed by them that they were not able to understand as to why I was involved in the case as they could see no relevant evidence of any wrong doing by me.Infact they wrote a letter to my consultant saying just that so they would believe that I was not being delusional when I told them that I was being harassed by HMRC and charged with offenses that I obviously , based on the evidence, did not have any involvement in.During this period my post was being intercepted , (only HMRC can do this , the police do not have authority to ) my phones were being monitored and my email accounts hacked. This went on for 3 years and then the case was dropped just before it was due to go to trial after the evidence was reviewed by a replacement prosecution barrister and it was found that there was no evidence whatsoever against me.
Also during this period I suffered a violent citizen arrest by a council enforcement officer for council tax I did not owe as I have an SMI exemption and do not pay council tax because I am registered as being severely mentally disabled by other government agencies.Additionaly during this period my family of 4 dogs, mother, father and their son and daughter, passed one after the other.
Surprisingly after all this ended the NHS made serious mistakes in my treatment stopping essential medications for the treatment of my bipolar , my lamotrigine was stopped by mistake The latter is with the NHS ombudsman currently and it would seem a favourable report will be issued to me soon.
Added to all the above I am having to take Nuneaton and Bedworth council to tribunal to backdate my SMI exemption further than 6 six years.
All of the above and other incidences I have factual evidence, recordings, documents and other supporting media and can conclusively validate.
At a time when mental health is being highlighted it seems incredulous that so many government agencies abuse those of us with serious mental health diagnosis and when confronted and asked to compensate and apologise for their errors they all lie and deceive. Even worse because of the changes to legal aid in 2013 there is no funding to pursue them and to me it seems that they are aware of this and knowing there will be little or no consequences for their wrong doing they continue to act poorly when dealing with people with long standing mental health issues.
Along with this letter have attached 3 voice recordings which will go some way to validate some of the above. Additionally I will send other emails attaching more documents as not all can be attached to just one email.
As for the help I would like. My life is so very different to the one I had before all of these things happened to me, I was independent, not relying on benefits even though I would have been entitled to claim them .I would like help in funding legal representation to claim compensation from so many government agencies for their totally disregard of the law and regulations when dealing with me and to gain apologies from them. It will likely be too late to save my home as I am in court on the 18th of December to have it repossed. My life has been ruined beyond belief .
On one of the recordings you will hear of a civil action against the police this never happened as I was asked for £10,000.00 to pursue this, which I did not have sadly.
Apologies for the late response, it is sadly a result of my poor mental health."
This a letter I sent to my local MP .The response saying that he could not help with legal advice or representations and could help with complaint processes , which materialised as simply sending site links as you know when we are ill we just don't have it in us to produce lengthy documents (which is why I simply pasted the above) and expected the MP would do the complaints for me after having signed a letter of authority at his request, this has not happened .
I would be interested to know if others have had b ad experiences involving government agencies.
